The Allegations

Many Foster Family Homes, Certified Family Homes, and Foster Family Agencies face tenuous allegations in the Accusation. The Accusations may paint a picture of child neglect, inadequate supervision or other actions contrary to the health, morals, welfare, or safety of the children in care. License Revocation

When the foster family home commits serious regulatory violations, participates in criminal conduct, or engages in repeated regulatory violations despite citations, civil penalties, a Non-Compliance Conference or Compliance Conference, the licensing agency may recommend that the license be revoked. If the licensing agency pursues revocation they will serve the licensee with an Accusation, a document giving formal notice of the administrative action to revoke the license.

Temporary Suspension Order

When the licensee or someone else in the foster home engages in physical or sexual abuse of others, or has seriously neglected those in care, or has been convicted of certain crimes or a violent felony or misdemeanor, or has inadequately supervised those in care to such a degree as to pose a substantial risk to health, safety or welfare, a temporary suspension order may be served with the Accusation.

The issuance of a temporary suspension order is severe. It will immediately close the foster family home and force those in care to relocate. Due to the severe nature of the temporary suspension order foster family home licensees have the opportunity to request an interim hearing. However, the request must be filed before a very short deadline to receive an interim hearing.
