RCFE Non-compliance Conference
The Non-Compliance Conference is the last step before license revocation. During the non-compliance conference, DSS will review your history of citations, deficiencies and outstanding issues. The seriousness of your situation will be conveyed to you in the form of a warning that failure to correct outstanding issues may result in your case being referred to the Legal Division for administrative action. The Department will document your 3-year history of citations, promised corrective actions, deadlines, and consequences for continued noncompliance on form LIC 9111. In the event you are unable to correct issues raised during the non-compliance conference DSS may, and most likely will, initiate the process to revoke your license.
Our license defense attorney can represent you at the Non-Compliance Conference. For many licensees the non-compliance conference is the last opportunity to forestall a license revocation action in favor of a voluntary plan for compliance. Save Money, Save Your License
It’s always better to resolve licensing matters before the Department has initiated administrative action to revoke your license. With attorney involvement at the non-compliance conference, The Department may agree to a compliance plan in lieu of immediate referall of your case to the Legal Division. Upon completion of the compliance plan and continued compliance with regulations you may continue to operate your facility.
The cost of involving an attorney at the non-compliance conference is less than retaining an attorney to defend you in a license revocation action before the Office of Administrative Hearings. The flat fee charged by an attorney for investigating your case, developing a pre-conference compliance plan, and representing you at the non-compliance conference is often a fraction of the fee charged for representation in license revocation proceedings.
If you have an upcoming non-compliance conference and desire representation by our attorney call Sacramento Law Group LLP at (916) 596-1018.
