License Revocation Process
California facilities licensed by the Department of Social Services are subject to license revocation actions for alleged regulatory violations. Once DSS and Community Care Licensing determine that regulatory violations are sufficient to warrant license revocation an “Accusation” is served to the licensee. The Accusation contains a list of allegations that state the basis for DSS’s case to revoke the license. Once an Accusation is received the licensee must timely file a Notice of Defense to defend their license in a formal administrative hearing. Given the seriousness of license revocation actions and the prospect of losing the business, licensee’s who receive an Accusation often retain a DSS defense attorney.
